Terms and Conditions
These terms are an agreement between you and BabbleHQ for use of the BabbleHQ website, iOS app, and related services. By creating an organization, accepting an invite, or signing in, you agree to them. If you use BabbleHQ on behalf of a club, you also bind that club.
Accounts
Club-owner accounts are for adults. Family and player access usually starts with an invitation from the club. You are responsible for the activity on your account and for keeping sign-in details confidential. We may refuse, suspend, or close an account that violates these terms or puts other users at risk.
The service
BabbleHQ helps clubs manage teams, rosters, schedules, dues, announcements, lineup cards, stats, and family communication. We may change features as we improve the product. Club-entered content (rosters, events, messages, public pages) is provided by the club, not by BabbleHQ.
Club responsibilities
The club is responsible for:
- The accuracy of roster, guardian, and billing information it stores.
- Having a lawful basis, including any required consent, to collect and share youth athlete information and photos.
- What it publishes on a public team page, including names, photos, and locations.
- Its own rules for dues, refunds, and communication with families.
Plans, dues, and fees
Platform access is billed according to the plan you choose at registration or later (monthly, annual, or pilot/comped access, including coupons). Prices shown at sign-up apply unless we notify you of a change.
Club dues are charged by the club through Stripe Connect. The club is the merchant of record for those dues. Families pay the club, not BabbleHQ, for team fees. BabbleHQ may charge a separate platform subscription and, when enabled, a transaction fee (currently 1.5%) on those dues, which the club can assign to the payer or absorb.
Payment processing is handled by Stripe under Stripe’s terms. Failed or disputed payments are between the payer, the club, and Stripe, except for our own platform charges.
Acceptable use
You may not:
- Use BabbleHQ for anything unlawful, or to harass, impersonate, or mislead others.
- Probe, scrape, or attempt unauthorized access to the service or another club’s data.
- Upload malware or content you do not have the right to use.
- Interfere with payments, impersonation safeguards, or other security features.
Public pages and intellectual property
Clubs grant BabbleHQ a license to host and display the content they upload so we can provide the service, including public team pages they enable. BabbleHQ and its licensors own the BabbleHQ software, branding, and documentation. These terms do not transfer that ownership.
Disclaimer
The service is provided “as is.” We do not warrant that schedules, RSVPs, announcements, stats, or invoices are complete or error-free; that information is entered by clubs and families. We do not guarantee uninterrupted availability.
Limitation of liability
To the fullest extent permitted by law, BabbleHQ is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for disputes between a club and a family about dues, playing time, or team decisions. Our total liability for claims relating to the service is limited to the greater of (a) the platform fees you paid us in the twelve months before the claim or (b) one hundred U.S. dollars. Some states do not allow certain limitations; in those states our liability is limited to the maximum extent permitted.
Indemnity
If you are a club, you will defend and indemnify BabbleHQ against claims arising from your content, your handling of player or guardian data, your public team pages, or your collection of dues, except to the extent a claim is caused by our willful misconduct.
Termination
You may stop using BabbleHQ at any time. We may suspend or terminate access if you breach these terms, if required by law, or if we discontinue the service. Provisions that should survive (including payment obligations already incurred, disclaimers, and liability limits) remain in effect.
Governing law
These terms are governed by the State of Delaware, United States, without regard to conflict-of-law rules. Courts located in Delaware shall have exclusive jurisdiction, except that we may seek injunctive relief in any venue for misuse of the service or our intellectual property.
Changes
We may update these terms by posting a new version on this page and changing the effective date. If a change is material, we will also provide a reasonable notice through the product or by email where we have an address. Continued use after the effective date constitutes acceptance.
